These Terms & Conditions ("Terms") govern your use of and access to all websites, membership platforms, courses, webinars, landing pages (including opt-in pages), and related services offered by New Horizon Creators ("Company," "we," "us," "our"). By accessing or using our services in any way, you ("User," "you," "your") agree to be legally bound by these Terms and our accompanying Privacy Policy. If you do not agree with all provisions, discontinue use immediately.

2. SCOPE OF SERVICES

(1) Primary Offering: We provide educational and mentorship programs that help content creators grow their audience, land brand partnerships, and monetize their content.

(2) Included Services:

• Online courses, video lessons, PDF guides, templates, and scripts

• Webinars, workshops, and virtual events (live or pre-recorded)

• Community forums (e.g., Skool), group coaching calls, and personalized feedback

• Sales funnels, lead-generation opt-ins, and related marketing resources

(3) Advertising: We run paid advertisements on various platforms (e.g., Facebook, Instagram, Google Ads), directing users to our websites, landing pages, and webinar sign-up forms.

3. ELIGIBILITY & USER RESPONSIBILITIES

(1) Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.

(2) Legal Capacity: By accessing or using our services, you represent that you have the legal capacity to enter a binding agreement.

(3) Accurate Information: You agree to provide truthful, current information and promptly update any changes.

4. ACCOUNT REGISTRATION

(1) Certain services require you to register. You agree to provide accurate, up-to-date information when creating an account.

(2) You are responsible for maintaining the confidentiality of your login credentials. Notify us at [email protected] if you suspect unauthorized use.

5. FEES, PAYMENTS & REFUND POLICY

(1) Fees & Billing: Some services (e.g., memberships, one-time courses, coaching programs) require payment. Fees are disclosed at purchase. We may change pricing upon notice.

(2) Payment Methods: We use third-party processors (Whop, Fanbasis, and Stripe). By submitting your payment info, you authorize us to charge applicable fees.

(3) Refunds:

• All sales are generally final and non-refundable once access is granted.

• Any money-back guarantee we offer is governed by the specific terms, conditions, proof requirements, and deadlines set out in your program enrollment agreement and disclosed to you at the point of purchase, and those terms control in the event of any conflict with this section.

• To request a refund under a guarantee, email [email protected] with the required proof before the deadline stated in your enrollment agreement.

(4) Late/Failed Payments: If payment fails, we may suspend or cancel your access until the balance is settled.

(5) Currency & Taxes: Fees are stated in USD. You are responsible for any taxes applicable in your jurisdiction.

6. INTELLECTUAL PROPERTY

(1) All content (videos, PDFs, scripts, text, images) is owned by or licensed to the Company and protected by law.

(2) We grant you a limited, non-exclusive, non-transferable license for personal, non-commercial use.

(3) You may not reproduce, distribute, modify, or exploit our content without written permission.

(4) User-Generated Content: If you post or upload anything on our platforms, you confirm you own or have permission to share it. You grant us a royalty-free license to use it for service operations.

7. DISCLAIMER OF RESULTS & EARNINGS

(1) All materials and coaching are for informational and educational purposes only. We do not guarantee specific outcomes.

(2) Testimonials or case studies are not guarantees of results. Your success depends on multiple factors, including effort and market conditions.

(3) We are not financial advisors, attorneys, or tax professionals. Consult licensed professionals for personalized advice.

8. DATA COLLECTION & PRIVACY

(1) We collect personal data (e.g., name, email, phone) and usage data (IP address, device info).

(2) We use the Facebook Pixel and Google Analytics to track user behavior and optimize ads. By using our services, you consent to such tracking.

(3) We comply with CCPA, CAN-SPAM, and, for users in the EU/EEA, GDPR, to the extent those laws apply to you.

9. SMS / TEXT MESSAGE PROGRAM

(1) Description of SMS Program: By opting in, you consent to receive text messages from Blue Horizon Partners LLC d/b/a New Horizon Creators. Our SMS program may include webinar confirmations, reminders, schedule changes, and access links; account and support notifications; and, where you separately opt in, marketing and promotional messages such as special offers, discounts, event invitations, and product updates.

(2) Opt-Out Instructions: You can cancel the SMS service at any time. To stop receiving messages, reply STOP to any text message. After you send STOP, we will send you a confirmation message and then stop sending you texts. If you want to rejoin, sign up again as you did initially and we will resume sending messages.

(3) Help: For assistance, reply HELP to any text message or contact us at [email protected].

(4) Message Frequency & Rates: Message frequency varies. Message and data rates may apply. Check with your carrier for details.

(5) Carrier Liability: Carriers are not liable for delayed or undelivered messages.

(6) Age Requirement: You must be at least 18 years old to opt in to our SMS program.

(7) No Sharing: We do not share, sell, or rent your SMS opt-in information or mobile phone number with third parties for their marketing purposes. See our Privacy Policy for details.

10. COMMUNITY GUIDELINES & USER CONDUCT

(1) Our community features (forums, calls) require respectful interaction.

(2) Prohibited Content: You must not post unlawful, defamatory, harassing, or otherwise objectionable material.

13. ADVERTISING & COMPLIANCE

(1) We run ads on platforms such as Facebook, Instagram, and Google, complying with their policies.

(2) We avoid false or misleading claims in our ads. Testimonials are individual results, not guarantees.

(3) By interacting with our ads, you consent to data collection as described in our Privacy Policy.

14. DISPUTE RESOLUTION & GOVERNING LAW

(1) These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

(2) Any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

(3) No Class Actions: You waive any right to participate in class or representative actions, to the extent permitted by law.

(4) Either party may seek injunctive relief for intellectual property violations in a court of competent jurisdiction.

15. TERMINATION

(1) You may cancel or terminate your account at any time by contacting [email protected].

(2) We may suspend or terminate your access if you violate these Terms.

(3) Upon termination, all licenses end immediately, but disclaimers and limitations survive.

16. INTERNATIONAL USERS

(1) We make no representation that our services are appropriate or available globally. You are responsible for compliance with local laws.

(2) If accessing from outside the US, you do so at your own risk.

17. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use after changes indicates acceptance.

18. SEVERABILITY & WAIVER

(1) If any provision is deemed invalid by a court, the remaining provisions remain in effect.

(2) No waiver of a right or provision is a waiver of any other right or provision.

19. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and any legal notices referenced, constitute the entire agreement between you and New Horizon Creators regarding the services.
